Scott Dozier is set to die by lethal injection at 8 p.m. local time at a state prison in Ely, Nevada.
Reuters reports Alvogen Inc. is petitioning to stop the Nevada from using it's drug in the execution.
Nevada Department of Corrections uses Alvogen's sedative midazolam in its three-drug execution cocktail.
Alvogen filed a lawsuit accusing Nevada of acquiring the drug unlawfully.
They also say that use of its product for an execution would cause “irreparable injury" to the company.
